Terms of use

1. General provisions

These Terms of Use (the Terms) govern the use of the website inmotion.kz and the patient account of InMotion Sport Clinic (the Clinic). By using them you accept the Terms; if you do not agree, do not use the website and the patient account.

The Terms do not replace the contract for medical services: such a contract is concluded with the Clinic separately.

2. The Clinic's website

The website is for information only. Information about methods, services and specialists is not a medical consultation, diagnosis or prescription of treatment and does not replace an in-person appointment.

Prices on the website are for reference and are not a public offer. The cost of treatment is determined after a consultation and is stated in the contract.

3. Appointment request

A request through the website form is a request to contact you, not a booking for a specific time. The appointment time is agreed with the Clinic's administrator.

By sending a request you confirm that you have provided your own data or the data of a person on whose behalf you act with their consent, and you consent to their processing in accordance with the Privacy Policy. Do not include in the comment any information that is not needed to book an appointment.

4. Patient account

Clinic patients get access to the account: sign-in uses the phone number from the medical record and a one-time code sent by SMS or issued at the Clinic. Do not share the code with anyone. If your phone is lost or your number has changed, tell the Clinic.

The exercise program in the account is drawn up by a Clinic specialist. Do the exercises as prescribed. If you feel severe or unusual pain during a workout, stop it and contact your specialist; in an emergency call 103 or 112.

Diary entries and workout check-ins are passed to your specialist, but the account is not meant for emergency communication: an immediate reply is not guaranteed.

5. User obligations

• provide accurate information;
• not try to access other people's data or disrupt the website and the account;
• not use the website and the account for advertising mailings or other unlawful purposes;
• comply with the legislation of the Republic of Kazakhstan.

6. Intellectual property

Texts, images, the logo, exercise videos and other materials of the website and the account belong to the Clinic or are used by it lawfully. They may not be copied or distributed without the Clinic's permission, except for personal non-commercial use. Photos with the author and licence stated are used under the terms of that licence.

7. Liability

The Clinic strives to keep the website and the account running without interruption, but does not guarantee this in the event of connection failures, failures at service providers and other circumstances beyond its control.

The Clinic is not liable for the consequences of doing exercises other than as prescribed by the specialist, or for the actions of people to whom the user has disclosed the sign-in code. Otherwise liability is determined by the legislation of the Republic of Kazakhstan.

8. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of the Terms.

9. Governing law and disputes

The Terms are governed by the law of the Republic of Kazakhstan. Disputes are settled by negotiation and, failing agreement, by a court at the Clinic's location.

10. Changes to the Terms

The Clinic may change the Terms. A new version takes effect when it is published on this page; the version date is shown at the top of the page.
